Terms of service.

Serenity Makeup reserves the right to amend these Terms and Conditions at any time. These Terms do not affect consumer statutory rights.  

ONLINE STORE TERMS

1. Our store is hosted on Squarespace. They provide us with the online e-commerce platform that allows us to sell our products and services to you utilising Paypal, Stripe and AfterPay payment software. 

1.1 Online orders may be paid for by secure credit card transaction or internet banking via the Squarespace e-commerce platform and utilising Paypal, Stripe or AfterPay payment software.

1.2 Serenity Makeup reserves the right to amend pricing at any time, based on price increases/decreases set by our suppliers and fluctuations in currency on imported items.

PAYMENT PORTALS

2. Your data is stored through the payment processors data storage, databases and general application. They store your data on a secure server behind a firewall. If you choose a direct payment gateway to complete your purchase i.e. pay by credit card, your credit card data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is then stored only as long as is necessary to complete your purchase transaction, after which time, your purchase transaction information is deleted. 

2.1 All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa & MasterCard. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECURITY

3. To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

BOOKING AN EVENT, LESSON OR EDITORIAL SERVICE

4. Bookings are essential.

4.1 Prices are based on a 1 hour booking for one service (makeup/ hair) or a 1.5- 1.45 hour booking for makeup and hair. If extra time is needed due to the client not being on time, then an invoice may be sent to the client with additional charges. If the service is conducted in less than an hour, no reimbursement of payment will be provided to the client.

4.2 All bookings are invoiced and to be paid in full before the date of the booking.

4.3 For bookings starting before 7am, there will be an early morning fee charged to your booking per artist booked. Please enquire.

4.4 All bookings that fall on a public holiday, there will be a surcharge added to your booking. Please enquire.

4.5 In the unlikely event that the Client is not satisfied with the service performed then the Client must inform the artist booked doing the service, at the time of the booking and allow the artist a chance to rectify the service.

4.6 We do our best to provide the artist that you have requested, however if in an unlikely event that the artist booked (including Serenity) cannot attend due to illness/ car breaking down/ car accident, we will do our best to replace the artist for you. In the case where this is not possible, we will send you a full refund of the initial payment made for that booking.

4.7 False lashes application is an additional $20 per pair for makeup and hairstyling, unless specified as included in the service description.

4.8 Travel will be extra. The travel fee is depending on your location from where the artist is travelling from and where you are located on the day of your event. This may be invoiced separately from your service payment if we can’t provide a cost before the booking date.

4.9 Parking will be extra if parking is required to do the booking. For some hotel based bookings, parking will need to be charged to your hotel room. In some cases the parking can get invoiced after the booking. Please check with us if you have a hotel booking.

BOOKING A WEDDING SERVICE

5. Bookings are essential.

5.1 We are currently not taking any Wedding day bookings from Brides who are travelling from anywhere overseas for their wedding day here in NZ.

5.2 For bookings starting before 7am, there will be an early morning fee charged to your booking per artist booked. Please enquire.

5.3 All bookings that fall on a public holiday, there will be a surcharge added to your booking. Please enquire.

5.4 Prior to the wedding, the artist booked to do the bride whether it is Serenity or an artist from her team, will perform the “Initial Consultation”, to determine make-up colours, application method, hairstyle wanted per the requirements of the Client.

5.5 Payment for the bridal trial must be made before the date of the trial.

5.6 A booking deposit of $150 is required in order to secure your preferred date and time for all wedding and group bookings. This deposit is non-refundable.

5.7 The final balance is to be paid 7 days prior to the date of the wedding booking. We will send you your final invoice before this is due.

5.8 There is a minimum booking of 6 services (this also can be makeup or hair only if preferred.) This applies to all wedding day bookings.

5.9 Every effort will be taken to accommodate any changes to the service performed within reason, however please be aware some changes may incur additional charges.

5.10 Changes to time and date will be taken into consideration, however this will not always be able to be met. In circumstances where changes cannot be accommodated then a refund of any payment paid (excluding the deposit), will be made to the client. Refunds will only apply to changes which are made 4 6.11 Cancellations must be made more than 4 weeks prior to the wedding date, after which the full remaining balance must be paid.

5.11 Waiheke weddings incur a car ferry travel fee of $300+. The amount includes the return car ferry ticket and time travelling to the island. This amount is based on 1 artist travelling to the island and back with their car. The fee would be extra, if extra artists are needed for your wedding day. There may be an extra mileage fee which will be depending on how far the artist needs to travel once arrived on the island . We can discuss this when you make your enquiry.

5.12 For any overseas wire bank transfers, a $35.00NZ fee will be added to payments made from overseas to cover transfer costs. Please advise if you are paying via wire transfer so we can add the fee to your invoice.

5.13 Your booking is subject to additional costs which will be calculated at the time of the consultation for mileage, fuel expenses and any parking costs involved.

DEPOSITS

6. We require a 50% deposit for all bookings (apart from wedding day bookings), which is invoiced and required at the time of your confirmation, to secure your preferred booking date and time.

6.1 The remaining amount will be invoiced and to be paid online 2 days before your booking.

6.2 There is a deposit booking fee of $150 for all wedding day bookings that is required at the time of booking, to secure your wedding date and time.

6.3 All wedding day deposits or any booking deposits are non-refundable.

6.4 We will not send any artist to you unless your appointment is paid in full prior to your booking date/ time.

CANCELLATION, NO-SHOWS & ARRIVING LATE FOR YOUR BOOKING

As cancellations and no-shows have significant impact on us, we need to enforce our cancellation policy and trust you understand our need to do so.

7. Cancellations must be provided at least 48 hours prior to your event makeup or lesson booking.

7.1 ‘No shows’, including vouchers and prepaid appointments, will be liable for the full price of the missed appointment.

7.2 If you do not show up or if you cancel your appointment less than forty-eight (48) hours before your scheduled booking time, you will incur a fee equivalent to 100% of the booked appointment.

7.3 Wedding service cancellations must be provided at least 4 weeks prior to wedding day bookings or else you will be liable to pay the total booking costs in full.

7.4 Please ensure you are on time for your appointment as a courtesy to the client that follows. If you are more than 10 minutes late, we will do our best to complete your service within the remaining time, however cannot guarantee that we will be able to complete your service.

7.5 Appointments that are secured by the deposit outlined in clause 7 above and are cancelled in accordance with our minimum cancellation windows (See clause 8 above) before the scheduled appointment time are valid for a full deposit refund.

CHANGES

8. Changes to time and date will be taken into consideration, however this will not always be able to be met. In circumstances where changes cannot be accommodated then a refund of any payment paid (excluding the deposit), will be made to the client. Refunds will only apply to changes which are made 48 hours prior to the booking, or 4 weeks prior to a wedding day booking, after which the full remaining balance must be paid.

GENERAL

9. All prices are in $NZD and include GST of 15%. Freight is additional and includes GST of 15%. 

SHIPPING

10. We will process your order as soon as possible within standard business hours.
Orders are processed and dispatched from our premises in Auckland for delivery within 2-5 business days depending on your area. We use NZ Couriers to deliver to locations within New Zealand only. Our freight rates can be viewed on our Shipping Page and include the packaging and preparation of your item. We will email you a confirmation once your order has been dispatched, including your tracking number. Please ensure to supply us with a physical address, such as a workplace, or home. We cannot ship your item to a PO Box.

10.1 Serenity Makeup take no responsibility for delayed delivery of products by third party service providers.

PRODUCTS

11. Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange according to our Return Policy. We have made every effort to display as accurately as possible the images of our products and we reserve the right to correct any errors, inaccuracies or omissions and to change or update information as required.

MODIFICATIONS TO PRODUCTS AND PRICES

12. All descriptions of products, product pricing, service and service pricing are subject to change at any time without notice, at the sole discretion of Serenity Makeup.

12.1. We reserve the right to discontinue any product at any time.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

13. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

RETURNS & EXCHANGES

14. Our policy lasts 14 days. If 14 days have passed since your product purchase, we can not offer you a refund or exchange. 

14.1 To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Please email us at info@serenitymakeup.co.nz to request a return.

14.2 Due to the nature of our products, we do not offer “Change of Mind” returns. We only offer refunds on items that have arrived damaged, or are found to be faulty.

14.3 Once your return is received and inspected, we will send you an email to notify you that we have received your returned item, and provide you with an update on the status of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within 5-10 business days depending on your bank. You should consider using a trackable shipping service when returning your item as we do not guarantee that we will receive your returned item. 

RIGHTS RESERVED

15. Serenity reserves the right to cancel any booking, and provide email notification of doing so, when a booking is in breach of these terms and conditions.

15.1 Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, drought, storm or other event beyond the reasonable control of either party.

INDEMNITY

16. By agreeing to the terms and conditions you indemnify any artist (including Serenity) from Serenity Makeup Ltd, from and against all actions, demands, claims, suits, damages, liabilities, losses, settlements, judgements, costs and expenses.

LIABILITY

17. Serenity Makeup artists are not liable for any allergies or skin irritations.

17.1 Serenity Makeup Ltd cannot be held liable under this contract where the client is unhappy with the finished make up/ hairstyling where Serenity Makeup artists have complied with the obligations under clause 4.

PRIVACY POLICY

18. We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.

18.1 If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

PERSONAL INFORMATION

19. When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you have completed a transaction, we invite you to register which allows us to retain your personal details i.e. your name, email, address and phone number, so that you won't have the tedious job of typing them in each time you buy online.

19.1 When you browse our store, we automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

19.2 When you provide us with personal information to make a booking or enquiry, complete a transaction, register, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If, after you opt-in, you change your mind, you may withdraw your consent at anytime, by contacting info@serenitymakeup.co.nz.

DISCLOSURE

20. We may disclose your personal information only if we are required by law to do so or if you violate our Terms of Service.
